The following document applies to the purchase, delivery, exchange, and return of products purchased in the online store www.pichoncito.pe.
These Terms and Conditions of the “Pichoncito” Online Store (hereinafter, the Online Store), through which Ediciones Pichoncito SAC (hereinafter, the Seller User), a Peruvian company with Tax Identification Number (RUC) No. 20603234643, markets its products. These Terms and Conditions apply to all Buyer Users for the purchase, delivery, exchange, and return of products purchased in the Online Store. Therefore, all Buyer Users are required to read and accept these Terms and Conditions each time they make a purchase in the Online Store.
These Terms and Conditions may be modified and/or updated by the Seller User at any time without prior notice. Therefore, it is the responsibility of Buyer Users to access these Terms and Conditions, which will be understood as read and accepted in their entirety each time users enter and/or use the Virtual Store.
I. About the purchase of products in the virtual store:
The offering and sale of products through the Virtual Store is the responsibility of the Seller User. Therefore, the Seller User is solely responsible for the offering and purchase process of the products offered to Buyer Users through the Virtual Store.
To purchase products from the Virtual Store, Buyer Users must select the products of their choice and add them to the Virtual Store shopping cart. Subsequently, to complete the checkout process, Buyer Users must provide the Seller User with their email address, telephone number, shipping address, and their selected payment method. They must first read and accept the Seller User’s Personal Data Processing Policy, these Terms and Conditions, and the Terms and Conditions of the website www.pichoncito.pe (hereinafter, the Platform) of Ediciones Pichoncito.
The Online Store will accept payments via VISA, Mastercard, Diners Club, and American Express credit and/or debit cards, as well as offline payments such as direct transfers to the Company’s or Yape’s account.
The Online Stores must only be used by persons of legal age who have the legal capacity to enter into contracts. The Selling User will not be liable if minors or persons lacking the legal capacity to enter into contracts use and access the Online Store. Therefore, parents, guardians, or custodians will be responsible for all acts or transactions that such persons carry out through the Online Store.
If the payment is correctly processed by the Online Store, the Selling User will send an email stating “Your purchase has been accepted,” confirming that the Selling User has correctly processed the purchase. If payment is made offline, i.e., through YAPE or direct transfer, the Buyer User must send proof of payment via email before receiving their product at home.
In accordance with the foregoing, Buyer Users accept and acknowledge that, through the Online Store, the Seller User makes an offer of products and that payment for the products by Buyer Users constitutes only a purchase request that must be validated by the Seller User. The Seller User will validate and/or approve purchase requests within a maximum of 24 hours of submission, via the email address that Buyer Users have provided to the Seller User for this purpose, after the Seller User has verified the validity of the payment method used.
The information appearing in the Online Store, such as stock, price, product characteristics, etc., is published by the Seller User. In this regard, Buyer Users accept and acknowledge that any outdated information, errors, or omissions in the information published in the Online Store are the sole responsibility of the Seller User. While the Seller User makes every effort to ensure that the products listed and/or published in the Online Store are in stock, it is possible that some of them may not be available, which is why the Seller User must first validate the purchase request.
Furthermore, the Seller User makes every effort to correctly record the prices of the products offered through its Online Store. However, Buyer Users acknowledge and accept that the Seller User’s Online Store may present incorrect prices. In such cases, the Seller User will contact Buyer Users to inform them of the correct price and verify that the Buyer Users agree with it. If there is acceptance by the Buyer Users, they must comply with the instructions provided by the Seller User so that they can pay the remaining balance corresponding to the correct price of the product in the purchase request, so that the Seller User can provide validation and/or acceptance of the purchase request, provided that the other requirements for validation are verified.
If the Buyer Users do not agree with the correct price, they may request cancellation of the purchase request, and the Seller User will process the corresponding reversal.
The validation stage concludes with the issuance of the respective payment receipt by the Seller User to the Buyer User. The Buyer User will be responsible for the information provided for the issuance of the respective payment receipt. The Seller User will only accept changes to the issued payment receipts if the information provided by the Buyer User was incorrect.
In the event that a purchase request does not receive the corresponding validation and/or approval, the Seller User will notify the Buyer Users by email. Likewise, the Seller User will take the necessary steps to ensure that the bank issuing the credit or debit card used by the Buyer User for the purchase request can process the corresponding reversal and/or refund. Buyer Users acknowledge and accept that the refund period will depend on the banking institution.
Buyer Users also accept and acknowledge that the Seller User may modify, at any time and without prior notice, the information contained within their own Virtual Store, related to the products (stock, price, features), product delivery restrictions, Terms and Conditions of the Virtual Store, among others, before providing validation and/or approval of a purchase request.
In cases where purchase requests have already been submitted by Buyer Users, the Seller User will contact the Buyer Users to inform them of the applicable modifications and verify whether the Buyer Users agree with them. If the Buyer Users agree, the Seller User will proceed to provide validation and/or acceptance of the corresponding purchase request, after verifying the other validation requirements. In the event of a dispute, the purchase request will not be validated and/or approved, and therefore, the Seller User will take the necessary steps to ensure that the bank issuing the credit or debit card used by the Buyer User for the purchase request can proceed with the corresponding reversal and/or refund. Buyer Users acknowledge and accept that the reversal period will depend on the bank.
Buyer Users accept and acknowledge that the images and/or photographs published by the Seller User within their Virtual Store are for reference purposes only, which is why the colors and dimensions of the products in said images and/or photographs may vary.
Although the aforementioned images and/or photographs may contain images of additional furniture and/or objects to visually illustrate the use and/or functionality of the offered product, this does not mean that said products are sold together or that the Seller User sells them through their Virtual Store or through another Seller User’s Virtual Store located on the Platform. All products sold by the Seller User through their Virtual Store will have their respective technical specifications, which it is the Buyer User’s responsibility to read in full before placing their purchase request for the product, in order to be certain of the characteristics of the product they wish to acquire.
Any disagreement that Buyer Users have regarding the product purchasing process within the Virtual Store can be registered by sending a complaint email to informes@pichoncito.pe.
II. Regarding the delivery of products by seller users:
Product delivery is the responsibility of the Seller User, and therefore, the Seller User is solely responsible for the delivery process of products purchased by Buyer Users through the Virtual Store.
The Seller User can manage product delivery nationwide.
It should be noted that product delivery will not be possible where legal access restrictions apply. Likewise, the estimated delivery times for products, depending on each delivery area, will be according to the following table:

Delivery of products offered through the Seller Users’ Virtual Stores will be made within a period of no more than three (3) business days, starting on the first business day following the Buyer Users’ receipt of the email confirming and/or approving the purchase request from the Seller User. Product delivery will only take place Monday through Saturday, from 9 a.m. to 6 p.m. for Metropolitan Lima and Monday through Saturday, from 9 a.m. to 6 p.m. for other areas of the country.
The Seller User will not be liable if the delivery address provided by the Buyer Users is incorrect, incomplete, inaccurate, and/or nonexistent. In such cases, the Buyer Users are responsible for contacting the Seller User directly and providing the correct address so that the products can be shipped to that address.
Buyer Users are responsible for being at the delivery address of the products within the estimated delivery time. Therefore, the Seller User is not responsible if the Buyer Users are not at the delivery address when the Seller User delivers the products.
Buyer Users accept and acknowledge that, in the event that they are not at the delivery address of the products at the exact time of delivery, third parties who are at said address are duly authorized by the Buyer Users to receive the products sold through the Online Store. In this regard, Buyer Users accept and acknowledge that delivery of the products will be made to the person who is at the delivery address of the products indicated by them. The Seller User is not responsible for any damage that may occur to the aforementioned products after said delivery.
In the event that delivery of products to the address indicated by the Buyer Users is not possible because the people at said address do not know or do not identify the Buyer Users and/or refuse to receive all of the products and/or refuse to identify themselves and/or provide their details (names, surnames, ID number) and sign the delivery note and/or proof of delivery, the Buyer Users will be responsible for making payment again for the product delivery service (delivery) to the same delivery address or to a new address, in accordance with the instructions that the Seller User will previously provide to the Buyer Users. In such cases, the Seller User will make every effort to contact the Buyer Users to coordinate the delivery of the products again. However, if the Buyer Users cannot be contacted for reasons attributable to the Buyer Users themselves, or if they do not respond and/or contact the Seller User within a period of 3 days from the last time the Seller User contacted the Buyer Users, the Seller User will not be liable for any non-delivery of the products.
The products will be deemed to have been delivered satisfactorily and in perfect condition when the corresponding delivery note and/or proof of delivery is duly signed and/or received, and includes the information (names, surnames, and ID number) of the Buyer Users and/or third parties who received the products, with no record of any discrepancies. In this regard, the Buyer Users accept and acknowledge that any subsequent discrepancies will not be the responsibility of the Seller User.
In the event of dissatisfaction with the delivery of any of the products, Buyer Users and/or third parties present at the delivery address must record such dissatisfaction on the delivery note and/or proof of delivery, including their information (first name, last name, and ID number) and signature. Buyer Users must subsequently contact the Seller User via email at informes@pichoncito.pe and submit the corresponding exchange or refund request, providing the corresponding supporting documentation.
The Seller User will not be liable if the products cannot be delivered within the estimated timeframe to the delivery address indicated by the Buyer Users due to force majeure and/or unforeseeable circumstances.
Any dissatisfaction that Buyer Users may have regarding the product delivery process, delivery conditions, product packaging, condition of the delivered products, non-delivery, or late delivery of products may be registered as a claim by sending an email to informes@pichoncito.pe.
III. Exchange and return policy for seller users:
Product exchanges or returns are the responsibility of the Seller User, and therefore, the Seller User is solely responsible for the exchange or return process for products purchased by Buyer Users through the Virtual Store.
To request a product exchange or return, Buyer Users must submit their request to the Seller User at informes@pichoncito.pe with the corresponding supporting documentation. The request will be evaluated and responded to by the Seller User via email within a maximum of 3 business days, starting on the first business day following receipt of the request. If the exchange or return request is approved by the Seller User, Buyer Users must follow the Seller User’s instructions to proceed with the exchange or return. Buyer Users’ failure to respond to the exchange or return request cannot, under any circumstances, be construed as tacit acceptance of their request by the Seller User.
Buyer Users accept and acknowledge that the Seller User is solely responsible for the quality and/or suitability of the products sold through the Virtual Store. All products sold through the Virtual Store have a one (1) year factory warranty. Therefore, after the Seller User expressly verifies and confirms that any delivered product has a manufacturing defect, the Seller User will exchange or return the product after providing the corresponding approval of the exchange or return request made by the Buyer Users.
In the event that the Seller User approves the exchange or return of products that were delivered correctly, that do not present defects, or that were not observed at the time of delivery, the Buyer Users will assume all costs incurred for the return of said products to the address indicated by the Seller User, as well as all costs incurred for the delivery of the new product, if applicable.
To make exchanges or returns, Buyer Users must return the products in the same condition in which they were delivered, including all boxes and/or packaging, manuals (if applicable), which must be in optimal condition.
In the case of product exchanges, the delivery period for exchanging the product for another identical or similar product will be 15 business days, provided that stock is available. This period will be counted from the next business day after the product to be exchanged is returned to the Seller User by the Buyer User. In the event that stock is not available, within the same 15 business day period indicated above, the Seller User will contact the Buyer Users to coordinate whether they wish to wait until new stock of the product arrives or if they wish to receive a refund for the product’s value. Buyer Users may request a refund for the product’s value through a return or through the issuance of a credit note to make purchases in the Seller User’s Virtual Store. Credit notes will be valid for one (1) year from the date of issue and will have the following terms and conditions:
In cases where a refund of the product value is applicable through a reversal, the Seller User will make the necessary arrangements for the bank issuing the credit or debit card used by the Buyer User to make the payment for the product to proceed with the corresponding reversal and/or refund. Buyer Users acknowledge and accept that the reversal period will depend on the bank.
Any disagreement that Buyer Users may have regarding the Seller User’s response to their exchange or refund request or regarding the exchange or refund process may be recorded in the Complaints Book of the Seller User’s Virtual Store.
These Terms and Conditions are governed by Peruvian law; therefore, any dispute that may arise must be resolved in accordance with said law. Buyer Users agree to waive the jurisdiction of their domiciles and submit to the jurisdiction of the courts of Lima-Cercado.
